Oncura Health (“Oncura,” “we,” “our,” or “us”) is committed to protecting the privacy and security of personal and health information. This Privacy Policy explains how we collect, use, disclose and protect information when you visit our website, use our digital services, communicate with us, or receive care from Oncura Health.

This Privacy Policy does not replace our Notice of Privacy Practices (NPP). The NPP explains how Oncura Health may use and disclose protected health information (PHI), your rights regarding that information, and our responsibilities under the Health Insurance Portability and Accountability Act (HIPAA) and applicable law.

Where California law provides additional protections for certain categories of medical information or health care services, Oncura Health handles that information in accordance with applicable federal and California law. Susan specifically recommended this more precise framing rather than broadly describing all such information as “sensitive services.”

We may collect personal information that you voluntarily provide, including:

California and federal law provide additional confidentiality protections for certain categories of medical information, which may include mental health records, HIV-related information, substance use disorder records and certain reproductive-health information. We use and disclose this information only as permitted or required by the law applicable to the particular information.

Under California’s Confidentiality of Medical Information Act (CMIA, Civil Code § 56 et seq.), we will not disclose your medical information without a valid written authorization signed by you or your legal representative, except when disclosure is permitted or required by applicable law.

All uses and disclosures of PHI are subject to HIPAA and other applicable federal and California laws.

5. Specially Protected Medical Information

We use and disclose this information only as permitted or required by the law applicable to the particular information.

Reproductive-Health and Abortion-Related Information

California law provides additional protections for certain identifiable medical information related to abortion and abortion-related services. Oncura Health will not disclose or provide access to this information in response to out-of-state subpoenas, investigations, law-enforcement requests or other requests when California law prohibits the disclosure or access.

Other reproductive-health and gender-affirming-care information is handled in accordance with applicable federal and California law.

HIV, Mental Health and Substance Use Disorder Information

California and federal law impose additional confidentiality requirements on certain records, including some HIV-related information, mental health records and substance use disorder records. We use and disclose this information only as permitted or required by the law applicable to the particular record.

Certain substance use disorder treatment records may also be protected by federal requirements under 42 CFR Part 2.

6. Patient Portals and Digital Communications

Oncura Health provides patients with secure online access to certain health information through the Navigating Care patient portal. Depending on the services available through the portal, patients may use it to access health information and communicate with their care team. This matches the language in the current Oncura NPP.

Patients are responsible for safeguarding their account credentials and should not share passwords or other authentication information.

Standard email and text messaging may present privacy and security risks. Patients should use designated secure communication methods when transmitting sensitive health information whenever available.

I intentionally removed the statement that all portal communications “are encrypted and monitored.” Unless IT/Privacy has specifically confirmed both representations, we should not promise them in a public policy.

7. Cookies and Similar Technologies

Our website may use cookies and similar technologies to:

Maintain website security

For medical-record requests, the current California-adapted Compliance template states that Oncura will permit inspection during business hours within five working days after receipt of a written request and transmit requested copies within 15 days after receipt of the written request, subject to applicable law.

Requests for confidential communications will be honored when required by applicable federal or California law.

9. California Privacy Rights

California law provides additional privacy protections for certain personal and medical information.

Depending on the information involved and applicable law, California residents may have rights regarding access to, correction of, deletion of or other handling of personal information.

Medical information maintained by Oncura Health may be governed by HIPAA, the California Confidentiality of Medical Information Act (CMIA), and other applicable federal and California laws.

10. Data Security

Oncura Health uses administrative, technical and physical safeguards designed to protect information against unauthorized access, use, disclosure, alteration or destruction, as appropriate to the nature of the information and applicable law.

We are required by law to maintain the privacy and security of PHI and will provide notification as required by law if a breach occurs that may have compromised the privacy or security of protected information.

11. Third-Party Websites and Services

Our website may contain links to websites, applications or services operated by third parties. Oncura Health does not control the privacy or security practices of third-party websites and services.

We encourage you to review the privacy notices applicable to those services before providing personal information.

12. Privacy Complaints

If you believe your privacy rights have been violated, you may file a complaint with Oncura Health.

You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights. You may also have the right to file a complaint with an applicable California regulatory authority.

Oncura Health will not retaliate against you for filing a privacy complaint.

13. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes to our practices, technology, legal requirements or other circumstances.

When this Privacy Policy is revised, the updated version will be posted on this website with a revised “Last Updated” date.
